Scalitoisms v. Strict Constructionists

here is a truly scary thought. What if the folks in the Senate Judiciary Committee were to raise questions towards the Supreme Court Nominee with regards to the"'founding father's original intent" and a strict constitutional constructionists interpretation of the minimum requirement to invade another sovereign nation. Or would that mean that the Senate Judiciary Committee would have to grow enough stones to even become aware that the united states was obliged of international law to declare itself the occupying power in Iraq?
